Judge Stops Bush Giveaway to Polluters at Oglethorpe Power

On May 6, a federal judge dealt a major blow to the Bush administration by rejecting the administration’s approval of a polluting coal plant in Georgia. The Court’s decision says that the EPA wrongfully approved a new permit to Oglethorpe Power because the company was already breaking clean air laws at its other plants. This is a great victory for clean air in Georgia and across the nation.

The decision is a major setback for the Bush administration, which has repeatedly tried to rewrite the Clean Air Act to let big polluters off the hook. In this case, the administration was given a clear chance to enforce the law but instead it tried to talk its way out of its responsibilities. The Court saw through the administration’s doublespeak and ruled that its actions were arbitrary and capricious.
