2 Judicial & Legal:
Judicial Nomination of Janice Rogers Brown to DC Circuit

Our Position: oppose
Bill Number: PN201
Sponsor: Nominated by President Bush
Legislative Session: 2005

Janice Rogers Brown, who was nominated to the DC Circuit Court of Appeals, has an extensive record illustrating her radical positions and her avowed hostility to government regulations.

Janice Rogers-Brown's antagonism to the regulatory role of government was poignantly expressed in a speech where she criticized a case upholding Washington State's minimum wage law for women.  She also showed her hostility towards environmental government regulations in a case where she threw out EPA's rules which tackle the public health threat of smog and soot. Luckily, the Supreme Court later threw out this gross misreading of the law.

The Senate's confirmation of Janice Rogers Brown could have serious and long-term impacts on the nation's environmental protections.  Justice Brown's avowed hostility to laws that protect our air, water, and lands and her tendency to rule based on personal philosophy make her unfit to serve on the D.C. Circuit, which handles a vast number of cases involving federal environmental safeguards.

Status

Janice Rogers Brown was confirmed by a vote of 56-43 on June 8, 2005.
