Summary
On March 16, 2011, the FRAC Act was reintroduced into both chambers of Congress. The "Fracturing Responsibility and Awareness of Chemicals Act," commonly called the "FRAC Act," would regulate fracturing under the Safe Drinking Water Act (SDWA) and require that the types of chemicals injected underground with water in the process be made public. In the House, the bill has been given the number H.R. 1084. Background: In June 2009, Democratic members of Congress introduced twin bills to amend the Safe Drinking Water Act and give the Environmental Protection Agency authority over hydraulic fracturing. The bills require the energy industry to disclose the chemicals it mixes with the water and sand it pumps underground in the fracturing process, information that has largely been protected as trade secrets.
