Vote No on Amendment 82: Protect Our Constitution from Corporate Pollution

Sierra Club is calling on our fellow Coloradans to reject Amendment 82, a dangerous proposal backed by the dark money group Advance Colorado that would warp our state constitution to benefit corporate polluters while harming Colorado communities. This attack on our constitution is opposed by dozens of Colorado organizations and civic leaders.

No pollution in the constitution words over a smoke stack

It is already legal to use natural gas for heating and cooking in Colorado, and Amendment 82 would do nothing to expand customers’ energy choices. What this Amendment would do is:

  • Lock in a constitutional right for corporate polluters to sell fracked methane gas, and
  • Invite costly lawsuits by polluting industry groups and corporate lawyers to upend commonsense protections for our health, climate, and energy bills.

The policies threatened by Amendment 82 range from safety rules that prevent pipeline explosions to consumer protections against utility rate hikes for new gas pipelines that customers don’t want or need. Coloradans are already facing fossil fuel price spikes driven by Trump’s war in Iran and energy-guzzling data centers - we cannot let special interests permanently enshrine fossil gas in our constitution.

Amendment 82 would also threaten Colorado’s climate and clean energy leadership, putting us all at greater risk of snowless winters, raging wildfires, historic droughts, extreme heat waves, and health-harming smog pollution. And it would undermine local communities' ability to choose the energy policies that are right for them.
