In June, we updated you on a preliminary injunction in our lawsuit challenging the Trump administration’s unlawful freeze of the $5 billion National Electric Vehicle Infrastructure (NEVI) program, which unfroze roughly $1 billion in funds in 14 states. The NEVI program is a transformative bipartisan initiative intended to build the backbone of an electric vehicle (EV) fast-charging network along America’s highways, enabling long-distance EV travel across the country.
On August 11, 2025, the Federal Highway Administration released new requirements for the program, aiming to streamline the application process. However, the new guidance requires that states resubmit their plans, further delaying the nationwide EV charging buildout.
Despite this lawsuit, the Trump administration is still illegally withholding billions of dollars that Congress has allocated to EV charging infrastructure. We will continue to push for the recovery of NEVI funding nationwide.
