Carbon Dioxide Pipeline Legislation passed House; now in the Senate

Update: this legislation failed to pass the Senate and is not advancing this legislative session.

The legislature is considering a bill that would prohibit the use of eminent domain for acquiring right-of-way for the construction or operation of a carbon oxide pipeline.

This bill - HF2104, previously HSB507, passed in the Iowa House.  It has now moved to the Iowa Senate, where it has passed the Senate Commerce Committee and is awaiting a vote in the Senate. 

Ask your Iowa Senate member to support HF2014, banning eminent domain on carbon oxide pipelines without an amendment.

Carbon Pipeline Property Rights Legislative is Advancing Fast in the House

During the Legislative off-season, targeted landowners and Sierra Club were working hard to make sure we could introduce and pass a bill that protects all Iowans from hazardous carbon pipelines.  That work paid off!

After Governor Reynolds vetoed our bill (HF639) in 2025, she asked for a clean bill with no unintended consequences. Well, we delivered a clean bill, HF 2104.  The bill would remove the threat of eminent domain from carbon pipelines - short, simple and clean. 

HF2104 was introduced in the House on Day 1 of the 2026 legislative session, passed out of subcommittee on Day 2 of the session and out of the Full Judiciary Committee on Day 3. The next week, our bill was debated by the House where it passed.  

Now it is in the Senate.

The carbon pipeline and ethanol industries are working hard to try to stop our bill. They may have more money, but we have more people.  Please contact your State Senator today and ask for their support of HF2104 without an amendment, a clean bill that protects Iowans’ property rights.

Summit’s Carbon Pipeline is Not a Climate Solution!

In a last-ditch effort to force their carbon pipeline through Iowa, Summit officially said that they will use the CO2 captured at Iowa ethanol plants to pump more oil out of the ground.  Enhanced Oil Recovery (EOR) is a process where CO2 is pumped into depleted oil fields to get the “hard-to-get” oil from the ground. 

For the last 5 years and under oath in front of the Iowa Utilities Commission, Summit claimed the CO2 would only be used for permanent sequestration.  But now, their real intent is exposed and Summit cannot claim their project will help the environment if it helps increase oil production and CO2 emissions.
