Washington, DC — La Corte de Distrito de DC invalidó anoche la decisión del Departamento del Interior (DI) de ofrecer 80 millones de acres del Golfo de México para arrendamientos petroleros y gasíferos, una victoria crucial en la defensa de las comunidades de la región y del planeta contra el empeoramiento de la crisis climática.
La corte dictó que el DI ni reveló ni consideró exactamente las emisiones de gases de efecto invernadero que resultarían de la venta de los arrendamientos, en violación de una ley ambiental fundamental.
Earthjustice presentó el 31 de agosto una demanda en nombre de Healthy Gulf, el Centro para la Diversidad Ecológica, el Sierra Club y Amigos de la Tierra contra la secretaria del Interior, Debrah Haaland, y el Buró de Gestión de Energía Oceánica, tras el anuncio de la venta de arrendamientos 257. La demanda argumentó que el análisis de 2017 en el que se basó la administración Biden para ofrecer los arrendamientos adolece de errores fundamentales. La venta no solo contradice la promesa de la administración de reducir las emisiones de carbono entre un 50% y 52% para 2030 y así cumplir con compromisos climáticos, sino que también es ilegal y basada en análisis ambientales previamente desacreditados.
La decisión de la Corte de Distrito de DC exige responsabilidades al DI por subestimar groseramente los impactos climáticos y riesgos a las comunidades del Golfo antes de decidir ofrecer la mayor venta de arrendamientos petroleros y gasíferos en la historia de Estados Unidos. El dictamen asegura que las aguas y costas del país serán protegidas de más perforaciones dañinas y eventuales derrames en el Golfo. Una transición a la energía limpia es esencial para las comunidades del Golfo y un planeta en constante calentamiento. En lugar de expandir las dañinas perforaciones, tenemos que aprovechar este momento generacional único para proteger los terrenos y vías acuáticas públicos, y apartarnos de la dependencia de combustibles fósiles.
Al considerar ilegal la decisión del DI, la corte se asegura también de que no habrá daño alguno. Decida lo que decida el DI, tiene que empezar de cero y considerar los costos ambientales reales al subastar las vías acuáticas públicas a la industria de combustibles fósiles. Confiamos en que un estudio a fondo acabará en la innegable conclusión de que dicha subasta causará daños irreparables a las comunidades del Golfo y el clima.
La abogada de Rango del Sierra Club Devorah Ancel, emitió la siguiente declaración al respecto:
“Al no evaluar adecuadamente los impactos climáticos de esta masiva venta de arrendamientos, la administración Biden no solo incumplió con sus compromisos de acción climática, sino que también actuó ilegalmente. Nos complace que la corte le haya exigido responsabilidades por este acto descabellado. Seguiremos luchando por proteger a las comunidades de la Costa del Golfo de los peligros de las explotaciones costeras y del caos climático”.

Court Finds Massive Offshore Oil Lease Sale in Gulf Based on Faulty Legal Analysis
Washington, D.C—Last night, the D.C. District Court invalidated the Department of Interior's decision to offer 80 million acres in the Gulf of Mexico for oil and gas leasing, marking a pivotal victory in the fight to defend Gulf communities and the planet from the worsening climate crisis. The Court held that Interior failed to accurately disclose and consider the greenhouse gas emissions that would result from the lease sale, violating a bedrock environmental law.
Earthjustice filed a lawsuit on behalf of Healthy Gulf, Center for Biological Diversity, Sierra Club, and Friends of the Earth on Aug. 31 against Secretary of the Interior Debra Haaland and the Bureau of Ocean Energy Management following the notice of lease sale 257. The lawsuit argued that the 2017 environmental analysis that the Biden administration relied on to hold the sale is fatally flawed. The sale was not only counter to the administration’s pledge to reduce carbon emissions by 50% to 52% by 2030 and meet our climate commitments, but it is illegal and based on previously debunked environmental analysis.
The D.C. district court decision holds Interior accountable for grossly underestimating the climate impacts and risks to Gulf communities before deciding to hold the largest oil and gas lease sale in U.S. history. This ruling ensures our waters and coasts will be protected from additional harmful drilling and eventual spills in the Gulf, where the fossil fuel industry is already sitting on 8 million acres of leases on public waters. A clean energy transition is essential for Gulf communities and our increasingly warming planet. Instead of expanding harmful drilling, we must meet this once-in-a-lifetime moment to protect our public lands and waters and move away from our reliance on fossil fuels.
By vacating Interior’s decision to hold this illegal lease sale, the court has ensured that no harm will result from it. Whatever Interior decides to do, it must start with a blank slate and consider the full environmental costs associated with auctioning off our public waters to the fossil fuel industry. We’re confident that a full assessment will lead to the undeniable conclusion that holding a lease sale will cause irreparable harm to Gulf communities and the climate.
Reacting to this decision, Sierra Club Senior Attorney Devorah Ancel issued the following statement:
"The Biden administration's failure to adequately evaluate the climate impacts of this massive lease sale wasn't just out of step with their stated commitment to climate action, it was also illegal. We are glad that the court has held them accountable for this reckless action, and we will continue to fight to protect Gulf Coast communities from the dangers of offshore drilling and climate chaos."
