Banning Foam Food Service Products

In 2018, the Maryland General Assembly will consider legislation to ban expanded polystyrene (Styrofoam®) food service containers.  Passing HB 0538  is one of the Sierra Club Maryland Chapter’s top priorities.

Eliminating expanded polystyrene (EPS) food service containers would be a significant step in reducing roadside litter and the pollution of Maryland’s waterways, and in promoting public health.

Expanded polystyrene is one of the most pervasive products littering our landscapes and waterways, remaining in the environment almost indefinitely.  Discarded EPS breaks into increasingly smaller fragments, absorbs toxins and other pollutants in the water, and is eaten by fish, birds, and other wildlife.  Multiple studies indicate that every human has styrene in her or his body.

Are there environmentally friendly, practical alternatives to EPS food containers and loose-fill packaging?

Yes.  Banning these products will have a minimum impact on consumers and on food service establishments and retailers.  There are many alternative food service containers made of recyclable and compostable materials that are cost-effective, readily available, and already in use. 

Many communities across the country already have bans in place, including Prince George’s and Montgomery Counties.  Surveys conducted by the Sierra Club’s Prince George’s Group show that an overwhelming majority of the county’s food service establishments and retailers are complying and the ban is working, facilitated by efforts to educate businesses about the ban and available alternatives.
