Sierra Club Calls on FERC to Follow Court’s Decision and Halt ACP Construction

Revoked Permit Means Pipeline Backers Should Stop Building Controversial Pipeline

WASHINGTON, D.C. -- The Sierra Club is calling on the Federal Energy Regulatory Commission (FERC) to order the Atlantic Coast Pipeline (ACP) to immediately cease construction activities after the pipeline’s builders had their Incidental Take Statement vacated. This statement is granted by the U.S. Fish and Wildlife Service and authorizes construction efforts to incidentally kill certain threatened and endangered species. Federal law required the statement in this case because construction of the pipeline will be likely to adversely affect species protected by the Endangered Species Act.

The case was brought by the Sierra Club, Defenders of Wildlife, and Virginia Wilderness Committee and argued by Southern Environmental Law Center.

In response, Sierra Club Attorney Nathan Matthews released the following statement:

"Now that a federal court has revoked the Incidental Take Statement for the Atlantic Coast Pipeline, FERC must order an immediate halt to all construction activities along the full length of the proposed route. The Federal Energy Regulatory Commission should do its job and actually regulate this dirty, dangerous pipeline instead of rolling over for the polluting corporations making money off it.”
