12.7.2020 Update

Good News for the Delta: The U.S. Army Corps of Engineers (USACE) issued notice to advise Federal, State and local governmental agencies and the public that USACE is terminating the San Francisco Bay to Stockton, California Navigation Study and withdrawing its Notice of Intent (NOI) to prepare an Environmental Impact Statement (EIS) for said study.

The DSG group has taken up the cause to increase Port of Stockton Transparency because the Port fails to perform even the most basic puclic outreach such as posting the minutes to Port Commissioner Meetings.  Additionally, many environmental reports and studies are not to be found on the Port of Stocikton website and are only obtained through public information requrestions - now too many to count.

No information regarding which Port Policy was under consideration nor were any proposed changes posted in the presentations posted on the Port website as of 11.16.2020 11:30. Port Policies are important to the community and should be available to the public with other agenda presentations prior to the Commissioners vote. This lack of transparency and governmental openness is concerning. I believe that the Port Commissioners can do better.

Consent Item: Comments on 8.17.2020 Minutes approved 9.21.2020:

The Port of Stockton "Commissioner Duffy shared that the Port should look to upgrade the Commission meeting capabilities for those that attend/view the meetings off-site. Commissioner Barkett seconded those comments." Yet meeting audio is only available online with no call in audio which creates a barrier to disadvantaged community members without internet access.

Agenda Item 5 Comments:

The Strategic Plan information referenced the Basic Data for the Port’s Strategic Plan presented May 2020 to the Commission as a background to the current proposed action: possible approval authorizing the Port Director to select the Tioga Group, Inc. for consulting services for the creation of the Port’s Strategic Plan.  The information does not specifically include a community outreach effort since stakeholders are not defined and may be limited to financial stakeholders the focus of the Strategic Plan.  Every Port Planning effort should involve the community.  Will the Port include the community as a stakeholder in the Strategic Plan development process?

Notice of Amendment to Lease Terms for BEST Logistics, Inc located at 340 Port Road 22, Stockton CA  on 26 acres with 3 warehouses total 530,752 sq feet did not disclose whether or not any of the CARB lease modification requests that will improve community air quality has been included for the Commissioner’s consideration.

The DSG and other community partners are eagerly awaiting the disclosure of the Port’s plan for improving community outreach efforts.  According to the Port of Stockton’s 9.15.2020 letter in response to CARB’s 8.24.2020 letter, the Port has implemented the community outreach plan with the formation of an internal group comprised of the Port’s community outreach experts, environmental managers and tenants to improve communication between the Port, business partners, and tenants.  

A second engagement group, the Environmental Justice Task Force, is currently being formed. The DSG requests to be a part of the Environmental Justice Task Force as we have long been requesting that community outreach be a part of any project consideration.  When will the outreach plan be available for public review?  When will this Environmental Justice Task Force begin meeting?  What is the purpose and responsibilities for Task Force Members?

Comments Submitted by email in advance of the meeting: Thank you for trying a new way to make available the meeting to the public.  As a public agency this is of utmost importance.  When will the Port make available the Lehigh HRA that the Port indicated they would be preparing, when will the Cottonseed and Lehigh projects be moving on to the next stage of review, and when will the Port conduct a traffic study to help with idling trucks and traffic in the residential neighborhoods related to Port operations or the operations of their leaseholders?

06/15/2020 dated Port of Stockton EMISSIONS INVENTORY DRIVERS provided the reasons for the Port to perform a comprehensive inventory of greenhouse gas and air quality pollutants. The idea is long overdue but no timeline was provided for the completion of the emissions inventory. Please consider providing status updates on the progress of this worthy endeavor. Additionally, I have been informed that next year community outreach will become a criteria considered by Green Marine. Please consider implementing your public outreach inferred in your adopted policies. Finally, there is a need for a traffic plan which the Port currently does not have.

Comments submitted before the meeting: Public comments become public when they are read or otherwise become part of the Port Commission’s administrative record. There were electronic comments between Port staff and the public regarding the ability of the members of public to hear the audio feed during the May 6, 2020 Commission meeting. These records are not summarized or provided in total in the minutes of the May 4, 2020 meeting which were recently distributed.
Members of the public shall be allowed to address the legislative body publicly, according to Governor Newsom’s Executive Order N-29-20. The Port of Stockton has determined that verbal public comments are not to be allowed and that the Port of Stockton will only accept written comments limited to 250 words which are read when the Port Commission decides there is enough time. This has changed and become even more restrictive since the March 16, 2020 meeting when Zoom meetings first began and public verbal comments accepted.
The Port of Stockton Policy states: The Board shall make every reasonable effort to keep the public thoroughly informed of Port District operations and will engage, educate, and collaborate with the local community. Listening to the concerns of the public is collaborative and provides an avenue by which the public can engage with the Commission, the legislative body responsible for protecting the community from harmful environmental impacts of District operation. The Port of Stockton must follow it’s own policies regarding community outreach and make improvements to engage the public using the Zoom platform.

I was directed by the public inquiry unit to complete this form.  The port of Stockton is planning on certifying a final EIR on the Nustar Terminal Project without making the final available on the ceqa net - I have a pdf of their project page on ceqa net, as well as their transparency page (I made a public information requiest for the the final EIR), and their CEQA documents webpage which did not include the document they plan on certifying on Monday 4.6.2020.  The mitigation proposed in the DEIR and notifying the nearby disadvantaged community was inadequate.  Comments were submitted.  I am trying to provide a record for port of Stockton documents on the local Delta Sierra Group webpage under conservation.  The Port does not post minutes of meetings even after they have been approved and do not release draft minutes but do send the minutes to me with the current agenda.  Please Help!

Sierra Club Comments: First regarding the minutes of the Jan 2020 meeting which were approved at the Feb meeting.  I understand that staff determined that 60 days was not specified for the 3rd party review of the Wildfire Mitigation Plan.  At the meeting staff indicated that the Fire Marshall's review would be available in March 2020, yet the minutes made available do not reflect this - only that the plan will be submitted by July 1, 2020.  Please forward to the Sierra Club a copy of the Fire Marshall's findings when available.  Second, I would like to invite all Commissioners to attend the first meeting of the AB617 Advisory Committee to be held at the North Hall of thne Civic Auditorium.  The meeting will begin with food at 5:00 and begin at 5:30 on Wedesday 3.4.2020.

Port of Stockton CEQA webpage copies distributed to Commissioners and Staff

Sierra Club Comments;  Today I would like to provide all commissioners copies of the current Port of Stockton CEQA webpage.  At your December 16, 2019 meeting which I did not attend, the Targo lease update was discussed and a mitigated negative declaration was referenced.  Written comments about that lease update was submitted by a Sacramento legal firm claiming that CEQA was violated.  CEQA is intended to provide and disclose potential and actual environmental impacts associated with a project.  Rather than stating that saff interpreted that CEQA requirements were met, staff should have disclosed whether the mitigations that were approved in the Determination were met.  All referenced documents should be posted on the Port CEQA website.

DSG comment: When the Wilfire Mitigation Plan indpendent audit would be complete - March 2020 the basis for the Port eliminating the 60 day independent review was that their Sacramento representative told the Port that there was no time limit for the review.  Subsequently, I recontacted the CPUC but hav received no response.

DSG Public Comment regarding the NuStar Project:
The DEIR stated:Public participation is an integral part of the CEQA process. Public participation facilitates two-way communication between the public and the lead agency (the Port) decision makers, ensuring that public concerns and input are considered in the final decision. The Port’s public participation process ensures that interested persons are informed about discretionary decisions and have the opportunity to provide input. The Port also consults with public agencies in a variety of ways when developing CEQA documents, including direct agency outreach and distribution of documents.

 The June 25, 2019 Notice of Preparation was not posted on the Port of Stockton website nor was the comment period ending on July 24, 2019 announced during the Port of Stockton Commission meeting which is a public meeting held by the lead agency decision makers.  The December 2019 Draft Environmental Impact report was not located on the Port’s website nor was the DEIR’s circulation and comment period announced during the December 2, 2019 Port of Stockton Commission meeting.

 The adoption of the City of Stockton Envision 2040 General Plan calls for increased outreach efforts at the urging of community organizations.  As a City, we have recognized that certain members of our community do not have the same level of services and accommodations, Boggs Tract is one of those communities.  Boggs Tract is the residential area adjacent to the Port of Stockton.

 A workshop should be held to hear the concerns of the community before the  final EIR is prepared and briefing notices provided so that the community can be informed and knowledgeable when reviewing the final EIR.  A workshop should be held to ensures that interested persons are informed about discretionary decisions and have the opportunity to provide input.

A colleague of mine came across this CEQA notice on a proposed Port of Stockton terminal expansion (https://ceqanet.opr.ca.gov/2019100510/2) and wanted to make sure the Sierra Club was informed.  The Notice of Preparation (NOP) is available here: https://ceqanet.opr.ca.gov/2019100510/2/Attachment/UUnFxR.

The Notice of Preparation indicated potentially significant impacts associated with the following resource areas: aesthetics, air quality, biological resources, cultural resources, geology and soils, greenhouse gas (GHG) emissions, hazards and hazardous materials, hydrology and water quality, noise, transportation, and tribal cultural resources.  Any resource area that was found to have at least one impact that is potentially significant as indicated by the checklist will be included for full analysis in the DEIR. 

The Delta-Sierra Group of the Sierra Club requests that notices be provided whenever a CEQA document is available for review. Monday, September 23 at 7 pm - Coal Dust Pollution Central Methodist Church Pacific Ave, Stockton CA
Delta-Sierra Group as part of the Mother Lode Chapter has joined the San Francisco Bay and Redwood Chapters of the Sierra Club to fight coal dust pollution coal dustin the Bay Area and Stockton.  Up until 2012 shipments of coal from the port were negligible. From 2013 onward shipments have been massive. Thus far, 2014 saw the greatest amount shipped from the Port of Stockton - 2,109,932,704 metric tons. (A metric ton is 2204.62 pounds. Think of it as about 10% more than a ton.) This computes to about 2.326 million tons. In 2018 slightly more than 1,767 million metric tons were shipped. Coal shipments are estimated to have increased more than 80% in 2019. Health professionals and doctors around the world know that coal dust, specially fine coal dust, causes a range of diseases and health problems. Examples include an increased incidence of respiratory diseases like asthma and lung cancer.
