🚨 Kentucky’s Clean Water & Air Are Still Under Threat – Take Action Again!

We warned you last week—these bad bills are still moving fast! The Kentucky Senate has now passed SB 89, and it’s heading to the House. Meanwhile, HB 137 is nearing a House vote. We need to keep up the pressure to stop these attacks on clean air and water.

🌊 Senate Bill 89 (SB 89) – Eliminating Groundwater Protections

Sponsored by Sen. Scott Madon, SB 89 removes protections for groundwater pollution in Kentucky, even though 1.5 million Kentuckians rely on groundwater for drinking water. The bill would:

  • Exclude groundwater from state protections, allowing pollution to go unchecked.

  • Increase water treatment costs, making drinking water more expensive for families.

  • Weaken oversight of Superfund cleanups, allowing contamination to spread without required groundwater protections.

Kentucky has long enforced its own water quality rules beyond federal standards. SB 89 would take away our state’s ability to safeguard drinking water.

💨 House Bill 137 (HB 137) – Blocking Clean Air Enforcement

This bill, sponsored by Rep. Jim Gooch Jr., would ban the use of citizen-collected pollution data in enforcing air quality laws. It would:

  • Prevent regulators from using community-collected air pollution data to hold polluters accountable.

  • Undermine the Clean Air Act by restricting enforcement to only the most recent EPA-approved monitoring methods, ignoring other credible evidence.

  • Make it harder to address pollution in vulnerable communities, like West Louisville, where residents already face dangerous air quality.

This bill would weaken Kentucky’s ability to enforce clean air laws, forcing the federal government to take over enforcement—resulting in slower action and fewer protections.
